Ibinabo to remain in custody as court declines to rule on bail application

Former President of the Actors Guild of Nigeria, AGN, Ibinabo Fiberesima, Thursday, failed to secure bail from the Court of Appeal over incompetent application.

The court had, on March 11 upheld the decision of a Lagos High Court sentencing her to 5 years in prison. A three man-panel of the Court of Appeal headed by Justice UI Ndukwe-Anyanwu, said that the appellant failed to attach copies of the judgment that was delivered by the court which affirmed the five years jail sentence imposed on her. Justice Ndukwe-Anyanwu was supported by  Justices Samuel Oseji and Tijani Abubakar.

Ibinabo’s lawyer, Nnaemeka Amaechina, had  informed the court of an application dated March 14 stating that he had also served the application on the Lagos State government  (respondent). The court, however, could not hear the application as the it observed that the appellant failed to attach copies of the judgment of the court as exhibit, thereby rendering the whole application incompetent.
According to Justice UI Ndukwe-Anyanwu, the option left before the court was to either strike it out or  adjourn it till further date for hearing. Amaechina chose an adjournment to enable him do the needful while court subsequently adjourned the case.

In a related development, Ibinabo has asked the Supreme Court to set aside the judgment of the lower court. The embattled actress stated this in her Notice of Appeal. She argued that the the Court of Appeal erred in law when it affirmed the alteration by the High Court of Lagos state by setting aside the option of N100, 000 fine and substituting it with a term of 5 years imprisonment.
